You understand that by participating in the giveaway raffle (“Raffle“) you are accepting these terms and conditions (“Terms”) and agreeing to be bound by them. This Raffle is organized and administered by Zeta Services Inc. (“Zeta”).
The Raffle will give lucky winners the chance to win merchandise autographed by the band members of either Journey or the Foreigner. The entrants can enter into the Raffle with effect from 9th October 2023 to 24th October 2023, after which Zeta will draw lots at random to pick the lucky winners.
The entrants shall register themselves for the Raffle in the following manner:
This Raffle allows a giveaway of [one] Apple iPad, to a lucky entrant chosen by Zeta through a random draw of lots. Zeta will announce the name of this lucky winner on 25th October 2023, and they will be duly notified by Zeta. The lucky winner should collect their winning on 25th October between 2:00PM – 5:00PM
The decisions made by Zeta regarding the Raffle are final and binding. An entrant is not entitled to a prize under this Raffle until and unless the entrant is picked in the random draw of lots and Zeta has verified the entrant’s details. If an entrant picked for the giveaway cannot be contacted, the entrant forfeits the chance to receive the prize. Suppose the entrant picked for the giveaway is disqualified for any reason; Zeta will give the giveaway prize of that entrant to an alternate entrant picked through another random drawing of lots among all remaining eligible entries.
By receipt of any prize, the winner of the above giveaway agrees to release Zeta, its affiliates, and all representatives (collectively, the “Released Parties”) from and against any claim or cause of action arising out of their participation in the Raffle or use or misuse of the prize.
Except where prohibited by law, participation in the Raffle constitutes the entrant’s consent to Zeta and its agent’s use of their personal details shared with Zeta for promotional purposes in any media, worldwide, without further payment or consideration by Zeta. Zeta shall use all personal information of the entrant in accordance with its privacy policy available at https://www.zeta.tech/us/privacy-policy.
Zeta reserves the right to cancel, suspend and/or modify the Raffle or any part of it if any fraud or other factor beyond Zeta’s reasonable control impairs the integrity or proper functioning of the Raffle, as determined by Zeta in its sole discretion. In such an event, Zeta reserves the right to distribute the giveaway prizes at random from among eligible entries received up to the time of the impairment. Zeta reserves the right, in its sole discretion to disqualify any individual without compensation if it finds them to be tampering with the entry process or the operation of the Raffle or acting in a fraudulent/ abusive/ disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Raffle may be a violation of criminal and civil law, and, should such an attempt be made, Zeta reserves the right to seek damages from any such person to the fullest extent permitted by law. Zeta’s failure to enforce any term of these Official Rules shall not constitute a waiver of such right.
The Released Parties are not liable for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Raffle; (2) unauthorized human intervention in any part of the entry process of the Raffle; (3) technical or human error which may occur in the administration of the Raffle or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Raffle or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry in the Raffle.
Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Raffle or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court located in Las Vegas, Nevada; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Raffle, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to claim awards for, indirect, punitive, incidental, and consequential damages and any other damages. All issues and questions concerning the construction, validity, interpretation, and enforceability of these terms and conditions, or the rights and obligations of the entrant and Zeta in connection with the Raffle, shall be governed by and construed in accordance with the laws applicable in Las Vegas, Nevada without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the law applicable in Las Vegas, Nevada.
